PAYMENT


Each paid subscriber is responsible for the subscription fees and any charges incurred to access the Service. After you become a registered Subscriber, and after the initial subscription period of one month, three months, six months or one year as the case may be, VP automatically charges your credit card at the then current subscription fee rate applicable to your subscription term until you cancel your subscription through the subscription cancellation process on the Website or by contacting our office either by phone, email, US mail or other transmission. Monthly, Quarterly, Semi-annual and Annual Subscriptions are billed on the anniversary date of your original membership registration. If you cancel your subscription prior to the next charge date, your subscription will be subject to the Refund Policy below.


Charts, news, market update, and historical information on the Service are provided by a variety of reliable and competent sources. Daily updates are subject to market fluctuations and are based on the latest quotes received from third-party data contributors and may be subject up to a 20 minute delay. Market quotes and certain other information on this Website, as well as reference materials or links to other sites, are for general informational purposes only, and are not intended to be relied upon for transactional purposes. Neither VP nor any of its data or content providers shall be liable for any errors or delays in the content, or for any actions taken in reliance thereon.


Refund Policy

  1. Monthly and quarterly subscriptions: cancellable at the end of the current paid monthly or quarterly term - no refunds.
  2. Semi-annual subscriptions (initial six month subscription):
    1. Cancelled in the first 30 days - 100% refund.
    2. No refunds thereafter during the initial six month subscription
  3. Semi-annual subscriptions (renewals, each subsequent six month subscription after the initial six months):
    1. Cancelled in the first month after renewal - 70% refund
    2. Cancelled in the second month after renewal - 25% refund
    3. No refunds if cancelled in the third through sixth month of each subsequent six month subscription after the initial six months.
  4. Annual subscriptions (initial twelve month subscription):
    1. Cancelled in the first 30 days - 100% refund
    2. No refunds thereafter during initial twelve month subscription.
  5. Annual subscriptions (renewals, each subsequent twelve month subscription after the initial twelve months):
    1. Cancelled in the first month after renewal - 100% refund
    2. Cancelled in the second month after renewal - 70% refund
    3. Cancelled in the third month after renewal - 50% refund
    4. Cancelled in the fourth month after renewal - 25% refund
    5. No refunds if cancelled in the fifth through twelfth month of each subsequent twelve month subscription after the initial twelve months.


User Conduct On Websites:


While using the Service, you may not:

Subscribers to The Mortgage Market Guide Weekly and Platinum Marketing may redistribute these Services and its content to their clients, partners, prospects and others as the subscriber may see fit for their business purposes. The clients, partners, prospects and others receiving The Mortgage Market Guide Weekly and Platinum Marketing from the subscriber may NOT in-turn rebrand and redistribute as being from them. However, the clients, partners, prospects and others receiving The Mortgage Market Guide Weekly may redistribute The Mortgage Market Guide Weekly using the Send to A Friend button.

We have no obligation to monitor the Service. You acknowledge and agree, however, that we do retain the right to monitor the Service and, subject to the limitations of the VP Privacy Policy, to disclose any information as necessary or appropriate to satisfy any law, regulation or other governmental request, to operate the Service properly, or to protect itself or its subscribers. Subscription to this Service may be terminated at any time, and without cause, by either VP or the Subscriber, upon notification by, U.S Mail, overnight delivery service, telephone or e-mail. When termination is requested by a Subscriber, subscription fees are subject the Refund Policy listed above. Subscribers are liable for charges incurred by them until termination of service.

You acknowledge and agree that we may terminate your password or account or deny you access to all or part of the Service without prior notice if you engage in any conduct or activities that we, in our sole discretion, believe violate any of these Terms and Conditions, violate the rights of VP, or is otherwise inappropriate for continued access.

You acknowledge and agree that we may, in our sole discretion, deny you access, through the Service, to third party services, merchandise, materials or information on the Internet, and we shall have no responsibility to notify any third-party providers of services, merchandise or information nor shall we have any responsibility for any consequences resulting from lack of notification.

You agree to defend, indemnify and hold VP and its affiliates harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys' fees, arising in any way from your use of the Service or the placement or transmission of any message, information, software or other materials through the Service by you or users of your account or related to any violation of these Terms and Conditions by you or users of your account.


Miscellaneous:


The Terms and Conditions and the relationship between you and VP shall be governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. You and VP each agree to submit to the personal and exclusive jurisdiction of the courts located within the state of New Jersey.

The failure of VP to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
